Terms of Service

1. Acceptance of Terms

By accessing or using the Voom website (voom.co.il), mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years old, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Voom is a casual gaming platform that provides instant, browser-based games in a scrollable feed format. The Service includes gameplay, scoring, leaderboards, achievements, player profiles, and social sharing features. The Service is available through our website and iOS mobile application. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

4. Player Identity and Accounts

Voom uses a device-based identity system. When you first use the mobile app, a unique anonymous identifier is generated and stored on your device. You may choose a display name for leaderboards and public features. You are responsible for:

  • Any activity that occurs through your device's identity
  • Ensuring your display name does not contain offensive, misleading, or inappropriate content
  • Understanding that your identity is tied to your device and cannot be transferred to another device

We reserve the right to remove or reset display names that violate these Terms or are otherwise inappropriate, at our sole discretion.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Cheat, exploit bugs, use automation tools, bots, or scripts to interact with the Service
  • Manipulate scores, leaderboards, or achievement data
  • Harass, abuse, threaten, or harm other users
  • Impersonate any person or entity, or falsely represent your affiliation
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service, servers, or networks
  • Use the Service to distribute spam, malware, or other harmful content
  • Access or attempt to access another user's data or device identity

6. Intellectual Property

All games, content, graphics, audio, code, designs, trademarks, and other materials available through the Service are owned by or licensed to Voom and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Service without our express written permission. Your use of the Service does not grant you any ownership rights in any content or materials.

7. Scores, Points, and Achievements

Scores, points, experience points (XP), levels, stars, achievements, and other virtual items earned through gameplay have no monetary value, cannot be exchanged for cash or real-world goods, and are not transferable. We reserve the right to modify, reset, or remove scores, leaderboard data, achievements, or the entire scoring system at any time without prior notice or compensation.

8. In-App Purchases and Subscriptions

The Service may offer in-app purchases, including ad-free subscriptions and other premium features. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. By making a purchase, you agree that:

  • All sales are final and non-refundable, except as required by applicable law or Apple's refund policies
  • Subscription renewals are automatic unless cancelled before the renewal date
  • You can manage or cancel subscriptions through your Apple ID account settings
  • Prices are subject to change, with notice provided before any renewal at a new price

9. Advertisements

The Service may display advertisements provided by third-party ad networks. By using the free version of the Service, you consent to the display of ads. Ad-free experiences may be available through paid subscriptions. We are not responsible for the content, accuracy, or practices of any third-party advertisers.

10. Third-Party Services

The Service may integrate with or contain links to third-party websites, services, or content. These third-party services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services. Your interactions with third-party services are at your own risk.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, cheating, abusive behavior, or extended inactivity. Upon termination, your right to use the Service ceases immediately, and we may delete your data including scores, achievements, and profile information. You may stop using the Service at any time.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOOM, ITS OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US $100.00).

14. Indemnification

You agree to indemnify, defend, and hold harmless Voom and its operators, affiliates, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

15. Apple App Store Terms

If you access the Service through the Apple App Store, you acknowledge and agree that these Terms are between you and Voom only, not with Apple. Apple has no obligation to provide maintenance or support for the Service. In the event of any conflict between these Terms and the Apple App Store Terms of Service, the Apple App Store Terms of Service shall prevail with respect to your use of the app.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voom regarding your use of the Service and supersede any prior agreements or understandings.
